Update to Greenville, Mississippi ban on church services and $500 citations.
The DOJ intervened in the Greenville, Mississippi case of church members being given $500 citations for attending a drive through church service. On April 14, 2020, the DOJ filed a statement of interest in the courts in support of the church. Greenville Mayor Errick Simmons “decided to permit” the church members to exercise their Constitutionally Protected Rights.
The DOJ’s statement included this argument, and it seems this is truly what persuaded the Mayor.
“There is no pandemic exception, however, to the fundamental liberties the Constitution safeguards. Indeed, individual rights secured by the Constitution do not disappear during a public health crisis,” the statement reads. “These individual rights, including the protections in the Bill of Rights made applicable to the states through the Fourteenth Amendment, are always in force and restrain government action”
Mississippi Governor Tate Reeves, who had “applauded the Trump administration and Attorney General William Barr for a “strong stand in support of religious liberty”. He then went on to say, “The government cannot shut down churches. Mississippi is not China. This is still America. We will help support this any way we can.”
